Exclusion direction

Information for Gambling Providers ONLY.


An Exclusion direction is when a gambling provider excludes/bans a patron from whole or part of the venue or gambling activity.

This may occur if the gambling provider is concerned about a patron’s gambling behaviour and/or the gambling provider has been approached by a concerned friend or family member.


ISSUING AN EXCLUSION DIRECTION

If, following observations, the gambling provider believes on reasonable grounds that the patron has a problem with gambling, the gambling provider may exclude the patron from whole or part of the venue or gambling activity by giving the patron an Exclusion direction (Form 3D). An Exclusion direction will take effect immediately and remain in force for up to five years.

REVOKING AN EXCLUSION DIRECTION

An application to revoke an Exclusion direction may be made by the patron at least one year after the day the patron was given the Exclusion direction by giving the gambling provider a completed Revocation notice exclusion direction (Form 3F).

The gambling provider must consider the application and make a decision whether to revoke or refuse to revoke the Exclusion direction, within 28 days.

A patron may only apply to revoke their exclusion once each year commencing on the anniversary of the day the patron was given the Exclusion direction.
